Terms & Conditions

These website terms govern use of Clarivenda and the online listing application. The final agency mandate and any property-specific commission agreement are provided separately for review and signature before publication.

1. Service provider

2. The Clarivenda service

Clarivenda provides guided seller onboarding, eligibility and document review, listing preparation, publication and enquiry coordination. Submitting an application does not guarantee acceptance, publication, a particular portal placement, enquiries or a sale. Every listing is subject to human approval, an executed agency mandate and payment confirmation.

3. Price and term

The standard fixed agency-listing fee is €1,082.95 including 21% VAT (€895 before VAT) for six months. A further six-month term is €541.48 including 21% VAT (€447.50 before VAT) if offered and accepted. Two seller-requested listing edits and three accompanied viewing appointments within the stated Calahonda service area are included. Additional accompanied viewing appointments are €60.50 including 21% VAT (€50 before VAT). Corrections required by Clarivenda for accuracy or compliance do not count as seller-requested edits.

4. Success and partner-agency fees

If Clarivenda introduces the successful buyer, a 3.025% fee including 21% VAT (2.5% before VAT) is payable on the final sale price. If a collaborating agency introduces the successful buyer, a 3.025% partner-agency fee including 21% VAT (2.5% before VAT) is payable on the final sale price. No success fee is charged when the seller independently finds the buyer, subject to the introduction and protection provisions in the signed agency mandate. The fixed listing fee is not refunded merely because the seller finds the buyer.

6. Review, rejection and refunds

Clarivenda may request corrections or reject a property where ownership, authority, legality, availability, information quality, photographs or platform eligibility cannot be verified. A full refund applies where a complete and compliant listing cannot be published for reasons outside the seller’s control. No refund applies where rejection or withdrawal results from false information, concealed mandates or duplicates, missing evidence, unlawful use, non-cooperation or a material seller breach. Any deduction during a statutory withdrawal period is limited to the proportionate value of work performed after an express request to begin.

7. Consumer withdrawal

Where Spanish consumer law applies to an online service contract, the seller normally has 14 calendar days to withdraw. If the seller expressly asks Clarivenda to begin during that period, a proportionate amount may be payable for work supplied before withdrawal. The right may end after complete performance when the legally required express consent and acknowledgement have been given. A withdrawal request may be sent to the contact email above.

8. Listings, enquiries and viewings

Public listings show an approximate location rather than the exact property address. Clarivenda receives and qualifies enquiries. Three local viewing appointments are included; outside the service radius, the owner normally conducts the viewing under Clarivenda’s coordination. Late cancellations and no-shows may count as used appointments as set out in the agency mandate.

9. Resales Online and third parties

Resales Online and other portals or agencies are independent third parties. Their acceptance, availability, rules and service levels are outside Clarivenda’s control. References to them do not imply ownership or exclusive affiliation. Initial listings may be entered manually during the pilot.

10. Liability

Clarivenda uses reasonable care in reviewing and presenting seller-supplied information but does not provide legal, tax, structural, planning or formal valuation advice. Nothing excludes liability that cannot lawfully be excluded. Subject to that limitation, Clarivenda is not responsible for losses caused by inaccurate seller information, independent third parties or events outside reasonable control.

11. Electronic contracting

The application identifies the steps before contracting and allows information to be reviewed and corrected. Contracts may be concluded in English or Spanish. Clarivenda will provide the applicable conditions and confirmation in a form that can be stored. The online application itself is not the final agency mandate.

12. Law and changes

These terms are governed by Spanish law. Mandatory consumer protections and competent consumer courts remain unaffected. We may update the website terms prospectively; the terms accepted for an existing paid service continue to govern that service unless the parties agree otherwise.
