What a power of attorney may authorise

The document should state precisely which actions the representative can perform. Its scope will depend on the sale and should be agreed with an independent Spanish lawyer.

  • The representative may be authorised to sign specified reservation, deposit or completion documents.
  • The authority may cover obtaining certificates and dealing with named public bodies.
  • It may permit the representative to coordinate repayment and cancellation of a registered mortgage.
  • It may cover agreed handover tasks involving utilities, community matters and keys.
  • It may authorise specified tax filings or administrative formalities connected with the sale.

Use the narrowest practical authority

Ask an independent Spanish lawyer to identify the property, actions, limits and end point. Understand delegation, receipt of funds and every power before signing.

Signing outside Spain

Documents signed abroad may require notarisation, apostille or legalisation, and sworn translation. Start early so formalities do not delay completion.

Choose the representative carefully

Confirm identity, professional status, communication and control of originals. Agree which major decisions require approval.

Revocation and expiry

Ask how authority ends, how it can be revoked and who must be notified. A sale-specific, limited power is easier to supervise than an unlimited one.
